How British Buyers Can Buy Property in Dubai: UK Tax Rules Explained (2026)

Share the Post:

Short answer: British buyers can own freehold property in Dubai outright, and the UAE charges no tax on the rent or the sale. If you live in the UK, HMRC does: Dubai rent is foreign income on your Self Assessment return and a gain on sale is subject to UK capital gains tax. If you live in the UAE and are not UK resident, Dubai rent and gains are generally outside UK tax.

British buyers ranked second in Dubai in 2025, at 17% of buyers according to Anarock.

If you live in the UK

  • Rent: declare it in the foreign section of Self Assessment. If you do not usually file, register by 5 October after the tax year the income arose. There is no UAE tax to credit, so the full UK rate applies.
  • Sale: capital gains tax is 18% or 24% in 2026 to 2027, after a £3,000 annual exempt amount.
  • Coming change: separate income tax rates for property income of 22%, 42% and 47% are due from 6 April 2027. Ask your adviser how they apply to overseas rent.
  • Inheritance tax: since 6 April 2025 the test is long term UK residence, meaning 10 of the previous 20 tax years. Long term residents are taxed on worldwide assets, Dubai property included, at 40% above £325,000.
  • New arrivals: people coming to the UK after 10 years abroad can claim the four year foreign income and gains regime, which can exempt overseas property income and gains in those years.

If you are British and live in the UAE

  • If you are not UK resident under the statutory residence test, Dubai rent and gains are generally outside UK tax.
  • Return within five years and gains made while abroad on assets you owned before leaving can be taxed in the year you come back.
  • The inheritance tax tail can follow you for up to 10 years after you leave, depending on how long you were UK resident.

The UK and the UAE have a double tax treaty, in force since 25 December 2016.

The Dubai side: the same for every nationality

  • Where you can buy: foreign nationals can own freehold property outright in Dubai’s designated freehold areas, which include most of the city’s main communities. See freehold vs non freehold in Dubai.
  • Transfer fee: the Dubai Land Department charges 4% of the price, plus registration and agency fees.
  • Off plan money: payments for off plan homes go into a project escrow account regulated under Dubai Law No. 8 of 2007.
  • Tax in the UAE: individuals pay no annual property tax and no UAE income tax on rent or gains. Your home country may still tax them, which is what the rest of this guide is about.
  • Residency: property worth AED 2 million or more can qualify you for the ten year Golden Visa. See the Golden Visa property threshold.
  • Buying remotely: you can sign and pay from abroad, or appoint someone by power of attorney. A power of attorney signed outside the UAE must be notarised and legalised for use in Dubai, because the UAE does not accept apostilles.
  • Mortgages: UAE banks lend to non residents, generally at 60% to 65% of the value, and most will not lend on off plan for non residents.
