The following day the Sharjah Executive Council issued Decision No. 30 of 2022, which allows buyers of any nationality to own property of all types and uses inside approved real estate development areas and projects, as absolute ownership not limited by time. That is genuine freehold.
The catch, and it is the important part. Approval is granted project by project, on application, by a committee that includes the Sharjah Real Estate Registration Department, the Land Planning and Survey Department, the Department of Economic Development and Sharjah Municipality. The Executive Council has never published a list of approved projects. So freehold in Sharjah is real, but it is never a blanket emirate wide rule, and every list of Sharjah freehold areas circulating online is assembled from developer marketing rather than from any government instrument.
Where a project has not been approved, the older route still applies. Under Executive Council Resolution No. 26 of 2014, a foreign national can hold a usufruct right of up to 100 years, registered with the Sharjah Real Estate Registration Department. That right can be sold, assigned within the remaining term, leased out and improved. Holders can convert to full ownership by signing a new contract and paying a registration fee reported at 2 per cent.
